Replace All Federal Taxes on Income with the Fair Tax Act , HR 25

FIRST: DC (pressure for those in the House and Senate to co-sponsor & PASS) the FairTax Leg.

AND

SECOND: Repealing the 16th Amendment, which is a STATE issue! There are elections going on at Congressional & State levels and we need to be asking the one running 1 of 2 things:
To those in DC: Will you co-sponsor HR25/S296
To those at our state levels: Will you vote YES to repeal the 16th Amendment?

That shared...has anyone sought taking the "repealing of the 16th Amendment" in this direction? A Ballot Initiative?!! And just how does one get that going or find out information on whether we can and if we can how to do so.

If one state starts it others will follow and it DEFINATELY enables us to turn up the volume about the FairTax legislation in DC!!

wow,,, i don't know. the ballot initiative sounds like a real good idea.
DC is a brick wall right now.....but the states are stirring and people see it is an easier way to get things done...or at least the snow ball started. Plus its a great platform for people to see what is possible in 2010/2012

I'm with Jim....firstly..'WOW' and secondly.......I think its a great idea.

I think we need to get groups in each state working on this....I'll bring it up at the OK FairTax meeting on the 25th and see where we are getting with our state legislature.

Jamie, I think you're really onto something here!

For all of those who might be wondering, lets take a look at the basics ...

According to my understanding, in order to actually repeal the 16th amendment, it will first take an act of both the House and Senate to amend the Constitution and pass that piece of legislation onto the states for passage.

That being said, I see no reason why we can't begin to work from the "bottom" up. As you suggest, each state could pass their own resolution to support the FairTax - mind you, not legally binding - but a strong statement none the less. For those state legislatures that don't wish to commit themselves without the consent of the people, then they could pass referendums to be placed on their ballots and let the people decide - that's assuming that once the people vote for the FairTax that they in turn will pass a resolution in support of the FairTax.

Again, none of this would be legally binding on the Congress - but just imagine the impact it might have if there are a majority of states with resolutions (and their Congressional delegations) in favor of the FairTax.

"Grass roots" means exactly that - maybe we might gain a lot more momentum by starting at the state level. Who knows? I, for one, am certainly willing to give it a try,
The Fair Tax of 2007 (HR-25) was changed when it was re-introduced as The Fair Tax of 2009 (HR-25).. There is a new section at the end of the Bill (Sec 401).

TITLE IV--SUNSET OF SALES TAX IF SIXTEENTH AMENDMENT NOT REPEALED

SEC. 401. ELIMINATION OF SALES TAX IF SIXTEENTH AMENDMENT NOT REPEALED.
If the Sixteenth Amendment to the Constitution of the United States is not repealed before the end of the 7-year period beginning on the date of the enactment of this Act, then all provisions of, and amendments made by, this Act shall not apply to any use or consumption in any year beginning after December 31 of the calendar year in which or with which such period ends, except that the Sales Tax Bureau of the Department of the Treasury shall not be terminated until 6 months after such December 31.


What this means is that the 16th Amendment DOES NOT NEED TO BE REPEALED BEFORE THE FAIR TAX IS ENACTED. Anyone that says it must be repealed so Congress cannot impose both the income tax and sales tax at the same time does not know what they are talking about. The Congess can impose both taxes today! There is nothing to stop them now. The Fair Tax will remove all income tax leglislation. Congress would have to pass another income tax code into law, and this would require time.

After the first 15 months under the Fair Tax (IMOHO) when the average American has been receiving their full paycheck and the monthly Prebate along without having to file the first 1040 tax return (and keeping all the necessary records) convincing them to repeal the 16th Amendment will be a lot easier. It could be done by the end of the second year!
Any State leglislature that will not act upon getting it ratified in the State will not remain in office very long!

Having said this, there will be 36 States need to be aware of the Fair Tax.. These states have a State Income Tax. The first line of their state income tax form asks for the Federal Adjusted Gross Income. There will be none! These states must modify their state taxing programs. It will need to be in place when the Federal Fair Tax goes into effect. Several states have started actions along the line of adopting the Fair Tax model at the State level. They will be ahead of the other states and will bring businesses to their State without having the corporate taxes! I think we need to educate the local politicians about the Fair Tax in order to pass the Fair Tax at the State level. Then their transition process will be much easier and simple. If one or two States do this, people will see the effects of the Fair Tax and want it for all states and the federal government!
