Compulsory Health Insurance is Blatantly Unconstitutional
The Federal Government has no such power of taxation’
The United States Constitution Article 1 Section 8, states; "The Congress shall have the power to lay and collect taxes, Duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States" The Constitution clearly did not allow a tax to be laid on an individual.
The 16th Amendment removed the enumeration and apportionment clause (allegedly) from the individual. But, it only granted the Federal Government the power to collect taxes based on “income” from whatever source derived.
Article 1, section 8 does not allow for a tax to be laid on any individual or corporation to be based on “public policies”, such as legislation to mandate a compulsory requirement to purchase health insurance”
The only thing that the 16th amendment did was to allow the federal government to tax income without apportionment’ “The Congress shall have the power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration"
For the federal government to mandate compulsory health insurance, they would have to first amend the Constitution!
There are those in the socialist camp who will say things like “most states have mandated auto insurance” This argument is ridiculous, because you must secure a drivers license to drive and therefore the states have determined that being granted a drivers license is a privilege granted by statute. This would mean that having a functional set of lungs or a heartbeat is a privilege granted by government, and therefore they must be insured.
A mandate to acquire health insurance cannot be called an excise, impost, or income. The government has no power to levy this as a tax, and no other such powers granted to hang their hat on!
They are not trying to conceal the fact that it is a tax, this is apparent based on the fact that it will be enforced by IRS.
