Replace All Federal Taxes on Income with the Fair Tax Act , HR 25

All,
I followed up with Ms. Bonnie Linhardt, Legislative Assistant to Representative Ed Emery, District 126, Missouri, 573-751-2165 about the status of the proposed Missouri FairTax Constitutional Amendment. The bill has been pre-filed for the legislative session that begins on Wednesday, January 6, 2010 as House Joint Resolution (HJR) 56 (last year it was HJR 36; don't look up the wrong resolution). Last year the resolution passed the Missouri House by a vote of 90-65 with one voting "present." It went to committee in the Missouri Senate, and the clock ran out.

This year the bill has a head start. Ms. Linhart advises me the composition of the Missouri House and the Senate has not changed because last year was not an election year. If the bill makes it through the House and the Senate this year, I understand it will by-pass the Governor and go directly to the citizens of Missouri for a referendum. Stay tuned.

Great news. I am trying to get WA State (which is pretty much a FairTax state already) to pass a resolution in the State Legislature asking the Federal Gov't to pass the FairTax as the best (only really) way to improve the economy of WA State. Have not made much progress but am persistent. Maybe Missouri can ask the Feds to do it when they pass it locally. I'd like to see all 50 states send resolutions to the Feds asking them to pass the FairTax. The current powres that be may listen to the states. They clearly don't listen to individuals.

We need to have all 50 states adopt the Fair Tax Model at the state and local levels including the prebate. Once the states have done this, the Feds will not be able to avoid it. The states can replace all state income taxes, property taxes, sales taxes at all levels (state and local jurisdictions with a one time consumption tax on new goods and services. It should also be an embedded tax so the shelf price it the total anyone pays. The prebate would offset the tax costs on basic necessities.

Once a few states start the process, the feds will follow the lead to the front as if it were their idea!

It has given me an idea for those people who live in states where the FairTax is not so far along as it is in Missouri and who want to engage their state-level elected officials. Do you have the language of your resolution? If not, here is a proposal which I put forth without pride of authorship and with an invitation for edits:

FAIR TAX [JOINT] RESOLUTION OF THE [STATE] [COMMONWEALTH] OF THE [STATE] [COMMONWEALTH]

WHEREAS
The federal Internal Revenue Code is complex and lacking in transparency, making it impossible for citizens of our [STATE] [COMMONWEALTH] to know whether they are in compliance and masking favors to special interests, and

WHEREAS
The federal Internal Revenue Code is inefficient, costing our [STATE] [COMMONWEALTH] three to six percent of its gross domestic product annually for none other than federal tax compliance, causing each household in our [STATE] [COMMONWEALTH] to expend unnecessarily each year an average of 37.6 hours in paying federal income tax, and facilitating evasion, and

WHEREAS
The federal Internal Revenue Code is biased against economic growth, and

WHEREAS
The federal Internal Revenue Code is a playground for special interests and lacks fairness, and

WHEREAS
The FairTax Bill, HR25 and S296 in the 111th Congress of the United States, to replace the federal Internal Revenue Code, is transparent, efficient, friendly to economic growth and fair,

NOW THEREFORE BE IT RESOLVED

That the [SENATE] and [HOUSE OF REPRESENTATIVES] [GENERAL ASSEMBLY] [NEBRASKA UNICAMERAL LEGISLATURE] of the [STATE] [COMMONWEALTH] of [STATE] [COMMONWEALTH] call for the Congress of the United State of America to pass and transmit to the President of the United States the Fair Tax Act of 2009, known as HR25 and S298 in the 111th Congress of the United States, and any and all re-introductions of this bill in subsequent Congresses, and it is further

RESOLVED
That the [SENATE] and [HOUSE OF REPRESENTATIVES] [GENERAL ASSEMBLY] [NEBRASKA UNICAMERAL LEGISLATURE] of the [STATE] [COMMONWEALTH] of [STATE] [COMMONWEALTH] call for the President of the United States to sign the Fair Tax Act of 2009, known as HR25 and S298 in the 111th Congress, or any and all re-introductions of this bill in subsequent Congresses, and it is further

RESOLVED
That the Clerk of the [SENATE] [HOUSE OF REPRESENTATIVES] [GENERAL ASSEMBLY] [NEBRASKA UNICAMERAL LEGISLATURE] be, and hereby is, instructed to transmit a certified true and correct copy of this [JOINT] resolution to each Senator representing this [STATE] [COMMONWEALTH] and to each member of the Congressional Delegation of this [STATE] [COMMONWEALTH] and to the President of the United States.
