Replace All Federal Taxes on Income with the Fair Tax Act , HR 25

Hello, I am always speaking to others about the FairTax and always gathering information to share. In my search I can across this skeptic that was making points that I wanted to have answers for. Could you Help?

You will note the date of that article was May, 2005. He refers to the Fair Tax Act of 2005.

It is true that the Fair Tax does not repeal the 16th amendment. That is an entirely different process. It requires passage of a law by 3/4 of the States. The Fair Tax does repeal all of the Internal Revenue Tax Codes and laws.

One of the major concerns opponents of the Fair Tax have is the possibility for an income tax to be reintroduced after the consumption tax is in place. The problem is that there is nothing to stop Congress from passing a sales tax NOW! What would be the difference.

The Fair Tax Act of 2009 has a built in "sunset" provision. If the 16th Amendment is not repealed within 7 years from the beginning of the Fair Tax, the Fair Tax would be eliminated and the Income Tax would be put back in place.

It is hard to believe that after a year or two under the Fair Tax, the American People would not be willing to repeal the 16th amendment and want to go back to filling out the IRS tax forms and keeping all those records. Also, would the average American want to give up the monthly prebate?
I have a question. Is there a good reason the Fair Tax Act of 2009 has this sunset provision built into it? Was the provision, for instance, put there as way of making the idea more palatable for fence-sitting Congressmen?
It was placed there because there was too much fear that politicians could reinstate the income tax codes if the 16th amendment was not repealed BEFORE the Fair Tax was put in place! (A stalling effort on the part of those opposed to the Fair Tax)

Did anyone ever question why Congress could not pass a sales tax (such as a VAT) next week? That CAN be done if they want and there very little to stop them (other than a Tea Party Revolt)!

Is it OK to have the income tax in place without a means to stop passing a sales tax but NOT OK to have the Fair Tax put in place and for a few years to pass a new amendment to repeal the 16th?

Dear Mr. Gabarino -

When your schedule permits, please send me an e-mail address where I can send you some follow up information. I checked out the article by the skeptic. He does bring up some interesting points. For me, if it were a choice between the FairTax and the current Federal Income Tax, it would be the FairTax hands down.

However, neither the Fair Tax nor the skeptic address an enormous problem that is a central part of the whole Federal Government taxation/spending question. I would like to send you some reading on this enormous problem and perhaps we could exchange some ideas. Unfortunately due to length limitations, doing so in a reply would not be possible.
